1) Acceptance of Agreement
1.1 Binding Agreement
This is a legally binding contract between you and Tripyatra Tourism Private Limited. Using or registering on the Platform means you accept it.
1.2 Eligibility
You must be at least 18 years old and legally competent to contract.
1.3 Updates
We may modify this Agreement by posting an updated version on the Platform. Continued use = acceptance.
2) Scope of Services
2.1 Platform Overview
- Book domestic & international hotels
- Book tour packages
- Book activities & attractions
- Book rental villas / houses / apartments
- Book rental cars
2.2 Intermediary Role
We act as an intermediary connecting Users with third-party Service Providers (hotels, tour operators, activity hosts, owners, car agencies). We are not the direct provider unless expressly stated.
2.3 Service-Specific Terms
Additional provider terms may apply during checkout. Unless stated, this Agreement prevails in case of conflict.
3) User Account & Responsibilities
3.1 Account Creation
- Create an account with accurate name, email, and phone to access bookings/history.
- You’re responsible for keeping credentials confidential and all activity under your account.
- Report unauthorized use to support@tripyatra.com.
3.2 Accurate Information
Provide current, complete, and accurate details at registration and booking. We aren’t liable for issues caused by incorrect inputs.
3.3 User Conduct
- Do not violate laws, impersonate others, disrupt the Platform (malware, overloads), or copy content without permission.
- Breaches may result in suspension or termination.
3.4 Photo ID Requirement
Carry a valid government photo ID (Passport/Driver’s License/Voter ID/Aadhaar) for check-ins and rentals. PAN card is not accepted for hotel check-in. Failure may lead to service denial without refund.
4) Booking & Payment
4.1 Booking Process
- Booking confirms after required payment and a Tripyatra confirmation email/receipt.
- We may decline bookings at our discretion.
- Special requests (early check-in, extra beds, vehicle type) are subject to availability/provider policy and not guaranteed.
4.2 Payment Terms
- Pay via card, UPI, net banking, or supported wallets; default currency is INR unless stated otherwise.
- Advance / Deposit: A minimum 10% deposit confirms any booking (hotels, tours, activities, villas/rentals, cars). You may also choose to pay 100% in advance. Any remaining balance is due before service start or as per provider policy.
- Displayed prices generally not include taxes; local extras (e.g., tolls, parking, mandatory gala dinners) may be payable directly to providers.
4.3 Pricing & Offers
Prices may change per provider policies. Promotions/discounts follow their displayed terms and may be modified/withdrawn without notice.
5) Cancellations & Refunds
5.1 Cancellations
Cancel via My Bookings or email support@tripyatra.com. Charges follow provider policy plus any applicable Tripyatra fee. Items marked non-refundable at booking aren’t eligible.
5.2 Refunds
Refunds go to the original method: typically 2–7 business days for bank/card and 2–4 hours for wallet refunds, subject to provider/bank timelines. We aren’t liable for external delays.
5.3 No-Show
No-shows are non-refundable and may be fully chargeable.
6) Limitation of Liability
6.1 Intermediary
Quality/performance of Services is the provider’s responsibility. Issues like overbookings, cancellations, or vehicle unavailability must be resolved with the provider.
6.2 Force Majeure
We aren’t liable for failures or delays due to events beyond control (disasters, unrest, pandemics, regulations).
6.3 Exclusions & Cap
- No liability for personal injury, property damage, financial loss during Services.
- No liability for losses from inaccurate info by Users or providers, or itinerary changes due to weather/roads.
- Maximum liability is limited to the amount you paid for the specific Service concerned.
7) Intellectual Property
All Platform content (text, images, logos, software) belongs to Tripyatra Tourism Private Limited or licensors and is protected by IP laws. You may not reproduce, distribute, modify, or create derivative works without prior written consent.
8) Privacy & Data Protection
- Your data is handled per our Privacy Policy. You consent to share necessary booking details with providers to fulfill Services.
- We use reasonable safeguards, but we aren’t liable for unauthorized access beyond our control.
9) Termination & Suspension
- You may stop using the Platform anytime; to deactivate, email support@tripyatra.com.
- We may suspend/terminate for Agreement breaches, fraud, unlawful acts, or misuse. Obligations for completed bookings/payments survive termination.
10) Dispute Resolution
- Governing law: India.
- Jurisdiction: Courts at Rewari, Haryana, India (update if your filing city differs).
- Process: Write to support@tripyatra.com. We aim to resolve within 15 working days. Unresolved matters may go to mediation/arbitration as per law.
11) Miscellaneous
- Entire Agreement: This Agreement + Terms & Conditions + Privacy Policy + Service-Specific Terms supersede prior communications.
- Non-transferability: Your rights aren’t transferable without our written consent.
- Severability: If a clause is invalid, the rest remain effective.
- No Waiver: Our failure to enforce a term isn’t a waiver.
